On November 27, 2019, a Kakamega High Court judge, Hon. Justice William Musyoka, made a ruling that would have far-reaching consequences for 22 students of Masinde Muliro University.
The students had been expelled after exercising their constitutional right to picket and demonstrate, as outlined in Article 37 of the Kenyan Constitution.
However, the institution claimed that they had merely implemented the recommendations of the Welfare and Disciplinary Committee, which had found that the students had caused unrest and damaged school property.
The judge stated that the application by the students had not provided sufficient background information on the events leading to their expulsion, and that they had failed to prove that they did not participate in the unrest.
Among those expelled was the chairman of the Masinde Muliro University Students Organisation, Mr. Vincent Lumala.
The lawyer for the petitioners, Mr. Collins Liyayi, vowed to appeal the decision.
