On November 15, Sports Registrar Rose Wasike wrote a letter to the Football Kenya Federation (FKF) cancelling the elections scheduled for November 23. The reason for the cancellation, as stated in the letter, was the non-registration of county sports associations, who are supposed to elect the officials of FKF.
According to Section 47 of the Sports Act, the Sports Registrar is required to register sports organisations as a sports club, county sports association, or a national organisation. In her letter, Wasike lamented how FKF boss Nick Mwendwa had ignored several summons following her previous letters, dated October 25 and November 1.
Wasike stated that she had called Mwendwa several times to advise on the election procedure before writing the letter of October 25, but he never turned up. It was only after receiving her letter on November 1 that Mwendwa promised to send her a letter with a commitment to cancel the elections scheduled for November 23, 2019, to allow time to register county sports associations that will vote officials of FKF.
Earlier, the Sports Disputes Tribunal (SDT) heard petitions by Jared Nyauma, Sam Nyamweya, Lodvick Aduda, Alex ole Magelo, Moses Akaranga, and Angeline Elijah challenging the legality of the polls. The petitioners argued that the electoral process was against the basics principles of democracy and undermined the FKF constitution, Fifa statues, Fifa standard electoral code, and the Constitution of Kenya 2010.
The tribunal will deliver its verdict on December 3, to rule on, among other issues, whether or not it had the jurisdiction to hear the matter and the validity of the entire electoral process.
