Philip Murgor Removed as Public Prosecutor ¶
Director of Public Prosecutions (DPP) Noordin Haji has removed Philip Murgor's name from the list of public prosecutors in Kenya.
On November 15, 2019, DPP Haji made changes to the gazette notice that had appointed Murgor as a public prosecutor, removing his name from the list.
Philip Murgor was representing Sarah Wairimu, the prime suspect in the murder case of Dutch businessman Tob Cohen.
However, Cohen's family, through their lawyer Cliff Ombeta, raised objections to Murgor's representation of Wairimu, citing a conflict of interest as Murgor was listed as a public prosecutor in the gazette.
Two days after the case was opened, Chief Magistrate Stella Mutuku ruled that Murgor should continue to represent Wairimu, as he had resigned from his position as a public prosecutor.
"A person cannot be forced to remain in office after giving their employer a letter of resignation. You are in the same position before this court and your decision to represent the accused has no complications," the court ruled.
