On April 29, 2019, a case involving the University of Eldoret and its former senior staff, Prof Ezekiel Kiprop and Hosea Sitienei, came to a head at the Nakuru Law Courts. The two had sued the university for unfair dismissal, and the court ultimately awarded them Sh38 million.
However, the university attempted to block the auction of 20 vehicles valued at Sh45 million to recover the awarded amount. In a letter dated November 11, 2019, the university's lawyer, Erick Gumbo, informed the Employment and Labour Relations Court Deputy Registrar that there was an order by the Supreme Court that enforcement of the judgment should be stayed.
Despite this, the court's Deputy Registrar issued a notice on November 12, 2019, recalling warrants of attachment by Kolato Auctioneers. However, this move was deemed irregular and of no legal force by Judge Monica Mbaru of the Employment and Labour Relations Court.
Justice Mbaru declared the Deputy Registrar's letter null and void, paving the way for the auction of the university's vehicles to proceed. The sale is intended to recover the Sh38 million awarded to Prof Kiprop and Hosea Sitienei.
