On November 15, 2019, the Director of Public Prosecution Noordin Haji issued a gazette notice amending the appointment of lawyer Philip Murgor as a public prosecutor.
The notice deleted the expression 'Philip Kipchirchir Murgor' from the list of public prosecutors, effectively revoking his appointment.
The move comes after a heated debate in a murder case involving Murgor's client, Sarah Wairimu Cohen.
On September 26, lawyer Cliff Ombeta told the court that Murgor's status as a public prosecutor was a matter of public interest, citing his appointment in January 2019 for a two-year term.
However, Murgor insisted that Ombeta should have filed a formal application challenging his position, and that his resignation on March 7, 2019, had been immediate and effective.
Despite the controversy, Justice Stella Mutuku ruled that Murgor could continue to represent Wairimu, noting that he was no longer a public prosecutor and that his resignation had been properly executed.
