Agent Charged with Assaulting Tenant in Lease Dispute

On October 1, 2019, a bitter argument erupted between Francis Waingwa Ndirangu, a caretaker, and Constatia Mbithe, a tenant, at Mbithe's shop in Ngara estate, Starehe Sub County.

The dispute was over rent, and it had been ongoing. However, the situation took a violent turn when Ndirangu allegedly grabbed and twisted Mbithe's neck, injuring her on the head.

Mbithe had vacated the premises managed by Ndirangu, but he continued to visit her shop, threatening her. She also claimed to have received threats from people who visited her shop, saying they were sent by Ndirangu.

Ndirangu denied the charges, claiming he had never set foot in Mbithe's shop or dwellings after she vacated his house. He also stated that the matter was a result of a tenancy dispute pending before the rent dispute tribunal.

Chief Magistrate Heston Nyaga freed Ndirangu on bond but warned him against contacting Mbithe, stating that failure to comply would result in the cancellation of the bond and his remand.
