On November 9, 2019, Nakuru Senior Resident Magistrate Yvonne Khatambi handed down a 30-year prison sentence to a 26-year-old man from Nakuru for defiling his 12-year-old niece.
The court found the man, EW, guilty of defiling his niece between 2017 and January 28, 2018, in Njoro sub-county, Nakuru County.
According to the prosecution, EW defiled his niece on multiple occasions, with the complainant testifying that it was not the first time she had been defiled by her uncle.
Despite the man's insistence on his innocence, the prosecution presented nine witnesses and clinical records showing the complainant was examined six months after the incident.
Magistrate Khatambi considered the accused a first offender, young, and remorseful, but noted that a non-custodial sentence would not serve justice to the minor.
“The court notes that the offence is serious and a non-custodial sentence would not serve justice to the minor,” Khatambi said.
The man has 14 days to appeal his sentence.
