Published on November 9, 2019, Onyango Oloo's ouster as Kisumu county assembly speaker has sparked a heated debate.
Justice Nduma Nderi is set to deliver a judgment on December 10 in a civil suit filed by Oloo, who claims his removal was unlawful and against the principles of natural justice.
Oloo's lawyer, Muga Apondi, argued that his client was removed from office over a criminal case unrelated to the assembly, and that he was not properly served before being impeached.
Through his lawyer, Carlos Odhiambo, Oloo cited several precedents, including the cases of Nairobi speaker Beatrice Elachi, former Kisumu speaker Ann Adul, Homa Bay speaker Elizabeth, and Embu governor Stephen Wambora, where petitioners were reinstated after being improperly served.
However, the assembly's lawyer, Elisha Ongaya, countered that it would be inappropriate to reinstate Oloo as speaker, citing the gravity of the allegations against him.
As the court deliberates, Oloo's fate remains uncertain, with the possibility of reinstatement hanging in the balance.
