Man Who Shot City Restaurateur Claims Self-Defence

On December 1, 2016, a dramatic scene unfolded in Nairobi's Garden Estate when Tom Oywa Mboya shot William Osewe, the owner of K'Osewe Ranalo Foods on Kimathi Street, in what Mboya claims was self-defence.

According to court testimony, Mboya had reported an alleged threat by Osewe to kill him in January 2015 at a petrol station. Mboya claimed that his friend made good on the threat on the day of the shooting.

On the fateful day, Mboya told Chief Magistrate Martha Mutuku that he saw Osewe draw his pistol and cock it twice, prompting him to draw his own gun in self-defence.

"I was faster than him," Mboya said, explaining that he aimed at Osewe's hands and shot him.

However, Mboya's account of the events has raised questions, particularly given that Osewe was shot three times in the rib cage and once in the arm.

Mr. Mboya, a licensed firearm holder, was charged with two counts of attempted murder and pleaded not guilty. He was released on a cash bail of Sh300,000.

The trial resumes on November 21.
