ICC Prosecutor Demands Arrest of Libyan War Crimes Suspects

On November 6, 2019, the International Criminal Court (ICC) prosecutor, Fatou Bensouda, urged Libya and Egypt to facilitate the immediate arrest and surrender of three Libyan fugitives to the Court.

The three suspects are wanted for war crimes, including murder, torture, cruel treatment, and crimes against humanity such as persecution, imprisonment, and inhumane acts.

Seif al-Islam al-Kadhafi, the son of Moamer Kadhafi, was believed to be in Zintan, Libya, according to Bensouda.

Arrest warrants were issued in 2017 for Al-Tuhamy Mohamed Khaled, the former head of the Libyan internal security agency, but Bensouda stated that he still resides in Cairo.

The third suspect is Mahmud al-Werfalli, a commander in Khalifa Haftar's Libyan National Army, who continues to enjoy his liberty in the Bengazi area, despite being promoted to lieutenant colonel in July.

Bensouda criticized Haftar's promotion of Werfalli, saying it sends a clear message that he has no intention to genuinely prosecute Werfalli for the crimes alleged in the ICC arrest warrants.

Several Security Council members have deplored the impunity enjoyed by the three suspects, with the Belgian ambassador to the United Nations, Marc Pecsteen de Buytswerve, urging the Security Council to add them to a UN sanctions list.
