On November 6, 2019, the High Court delivered a significant blow to the Independent Electoral and Boundaries Commission (IEBC) by ordering the commission to issue the Orange Democratic Movement (ODM) party with a complete Kibra voter register, complete with voters' details, in compliance with the law.
IEBC, however, expressed concerns that complying with the order would be a challenge, citing that they had already dispatched materials to Kibra polling stations and would need 10 days to supply the ODM party with the voter register before the Kibra by-election.
IEBC's lawyer argued, 'If we are to print the register, then it will be a great challenge. We cannot contact Delarue in the next two hours.'
ODM's lawyer countered, stating that the process was automated and that IEBC needed only to click a button to provide the information, saying 'The arguments are evasive if you grant orders of stay you would basically have declared your judgment redundant.'
Justice James Makau declined IEBC's request for more time to supply the ODM party with the voter register, but ordered the commission to supply the register before the by-election, as they had only a few hours to comply.
