On March 18, 2019, the Isiolo County Government suspended the operating licence of Nanyuki Express Cabs Sacco, accusing it of hiring goons who were harassing passengers.
However, the Sacco's lawyer, Wahome Gikonyo, argued in court that the suspension was unlawful since his client had not been given a chance to explain itself.
Mr Gikonyo claimed that the suspension was a blatant violation of the Constitution, as the petitioner had not been found guilty of violating the conditions of the operating licence or the Traffic Act.
Isiolo County, in an affidavit filed by Osman Halake, responded that the dispute was a result of a complaint raised by the Isiolo-based Meiso Nissan Operators Sacco Ltd.
The court's decision to quash the suspension means that Nanyuki Express Cabs Sacco can resume its operations in Isiolo County.
