High Court Bars Arrest of Nairobi County Officials

On October 26, 27, and 28, 2019, the director of Proland Ltd, accompanied by police officers, invaded the home of Simon Leboo, a Nairobi County official, and arrested him along with his family members.

Leboo's daughter, a fourth-year law student at the University of Nairobi, was allegedly molested and detained by police officers before being released without charges.

The High Court has issued orders barring the arrest of Leboo and three other officials - Pauline Kahiga, Halkano D. Waqo, and Johson Akongo - who were to be arrested for not paying Ksh.35 million to Proland Ltd and Iris Properties.

The officials argued that they have no control over the financial affairs of Nairobi City County and that the warrants of arrest against them are being executed in their individual capacities.

Lawyer George Kithy submitted to the court that the actions of Proland Ltd and the police were 'not a police state for heaven's sake' and that the Inspector General had deployed a contingent of General Service Unit officers at the premises of the applicants.
