The National Transport & Safety Authority's (NTSA) directive to install upgraded speed governors has sparked a legal battle. On Monday, November 4, 2019, the High Court will rule on transporters' application to suspend the directive.
The Kenya Transporters Association (KTA) has filed a petition at the High Court in Mombasa, arguing that the NTSA's demand for upgraded speed governors is illegal. According to the association, there was no gazette notice to compel the issuance of the order.
The transporters claim that the NTSA's demand for real-time location of vehicles is unconstitutional. They also argue that the date being transmitted to NTSA servers includes alerts every time the vehicle speeds, which could incriminate the driver.
The High Court's ruling is expected to have significant implications for the transport industry in Kenya.
