Nairobi County Assembly Speaker Beatrice Elachi has moved to court to suspend a court injunction stopping her from presiding over House sittings, citing compromised rights.

Elachi, through her lawyer Harrison Kinyanjui, argued that her rights to discharge her constitutional and statutory functions of the assembly had been curtailed by the order.

She claimed that she had never been served with any process in the matter and that no affidavit of service was ever filed, indicating how, when, and to whom process was served.

Elachi also sought to nullify her purported representation by lawyer Steve Mogaka and have the notice of appointment struck out and expunged from court records.

Her move comes as a section of Jubilee MCAs vow to oust her on the same grounds that saw her hounded last September.
