Court Orders Closure of Four Kilimani Night Clubs

On October 28, 2019, the Environment and Land Court made a landmark ruling in favor of Kilimani residents who had sued four popular night clubs in the area.

The court ordered the Nairobi County Government to revoke all permits and liquor licenses issued to KIZA, B-Club, Space Lounge, and Explorers Tavern, citing violation of the residents' right to a clean and healthy environment.

The Kilimani residents, under the Kilimani Project Foundation, had claimed that the night clubs were causing a disturbance in the area, with operators playing loud music daily and hosting rowdy drunken revelers, thereby depriving them of sleep and security.

The residents also alleged that the activities in the four clubs were having a bad influence on their children, violating their rights and fundamental freedoms.

According to the court judgement, the continued operation of the four businesses in the residential area is a violation of the petitioners' rights to life and a clean and healthy environment.

The court further ruled that the permits and licenses issued to the four clubs by the Nairobi County Government to operate are unlawful and illegal.

A mandatory injunction was issued against the Nairobi County Government, compelling it to revoke all liquor licenses issued to the four clubs.

However, the court issued a stay of execution of the said orders for a period of 30 days.
