Blow to Former NBK Company Secretary Over Alleged Leaking of Confidential Information

Published on October 28, 2019, a Court of Appeal decision has given the National Bank of Kenya the green light to pursue its civil case against its former Company Secretary, Leonard Kamweti.

The bank is seeking damages for alleged leaking of confidential information to third parties, a claim that has been upheld by the appellate judges.

On October 24, 2014, High Court judge Rose Ougo had referred the matter to the Employment and Labour Relations Court, a decision that has now been set aside by the Court of Appeal.

Appellate Judges Wanjiru Karanja, Fatuma Sichale, and Jamila Mohamed ruled that the bank's case was based on Kamweti's alleged breach of confidence, not his employment contract.

According to the judges, Kamweti's actions were malicious since he was not authorized to convey the confidential information.

Leonard Kamweti, however, denies any wrongdoing.

He was sent on early retirement on July 31, 2013, following the bank's restructuring.

The bank alleges that Kamweti conveyed confidential information about a meeting held by its board of directors on July 8, 2013, to the CBK Director of Bank Supervision, the Capital Markets Authority, and the Law Society of Kenya.
