On October 23, 2019, a court issued a conservatory order to prevent the eviction of over 10,000 families living at the Inyali settlement in Kitui County, pending a hearing and determination of a petition filed by the residents.
The court order, which was issued by way of injunction, restrained the respondents from evicting the petitioners or interfering with their quiet and peaceful possession of the Inyali settlement in Mutomo sub-county, Kitui County.
The petitioners, who are of both Somali and Oromo origin, have been living at the Inyali settlement for over 35 years, tending their herds and carrying on other economic activities on the property.
They claim to have been subjected to immense harassment, torture, and inhuman and degrading treatment by officers working under the behest of the Interior Cabinet Secretary, Inspector General of Police, and the Attorney General, since October 8, 2019.
The respondents named in the case include the County Government of Kitui, the National Land Commission, the Interior Cabinet Secretary, the Inspector General of Police, and the Attorney General.
