Published on October 23, 2019, a High Court ruling has sparked a turf war between the Senate and the Judiciary in the impeachment case of Taita Taveta Governor Granton Samboja.
Senators have vowed to proceed with the impeachment probe, citing their mandate under Section 33(4) of the County Governments Act, 2012, and standing order 75(2) of the Senate Standing Orders.
The special Senate committee, chaired by Embu Senator Njeru Ndwiga, has 10 days to hear the case and vote on the impeachment motion.
The move comes after Taita Taveta ward representatives voted to impeach Mr. Samboja last month for alleged misappropriation of funds, failure to deliver the annual state of the county address, and failure to remit statutory deductions, among others.
The High Court ruling last week barred the Senate and Taita Taveta County Assembly from discussing, hearing, and handling the impeachment motion.
