On October 22, 2019, ICT Association of Kenya chairperson and lawyer Adrian Kamotho filed a suit before the Communications and Multimedia Appeals Tribunal against Safaricom, Airtel Kenya, and Telkom Kenya.
Kamotho wants the telcos to be prevented from deactivating customers' unused data bundles upon expiry, arguing that forcing customers to deplete their data bundles within a specified period is irrational and discriminatory.
He also wants the telcos to make public their data tariff charges for easy tracking and to display the same on their websites so that users can track usage.
According to Kamotho, customers should be allowed to roll over and keep bundles even after expiry dates so long as their SIM cards are active and they keep recharging.
"Data bundles should not have an expiry date until used up, as long as the SIM card is active and the consumer keeps recharging," he argued.
He noted that the usage of data bundles is based on network and power availability, making it irrational to force users to deplete their data bundles within a specified period.
Former Kiambu governor William Kabogo had previously threatened to sue the network vendors over their data bundles expiry policies in June 2018 and June 2019.
