City Lawyer Takes on Safaricom and Airtel Over Data Bundle Expiry

On October 22, 2019, a complaint was filed with the Communications and Multimedia Appeals Tribunal by lawyer Adrian Kamotho, accusing top telecommunication operators of stripping customers of their bundles.

According to Kamotho, customers are entitled to keep their data bundles as long as they remain active on the vendor's network. He argues that data bundles should not have an expiry date until used up, as long as the SIM card is active and the consumer keeps recharging.

Service providers have a data outage model that ensures a consumer's data expires whether it was used or not. This model often affects the poor majority who use meager bundles with short life spans, resulting in consumers not getting value for their money.

Kamotho demands that providers serve clients with reasonable depletion notifications to enable them track their data usage. If his complaint receives needed attention, consumers will be protected from unfair trade practices.

Lawyer Kamotho is suing the operators for irregularly depriving consumers of their unused data bundles, immature expiration of hard-earned bundles, and insanely high data charges.
