Published on October 19, 2019, a group of 20 Kenyans has urged the High Court to withdraw Kenya from a border dispute filed by Somalia before the International Court of Justice.
The petitioners, represented by lawyer Kibe Mungai, argued that there is a risk of forfeiting part of Kenya's territory if the ICJ rules in favour of Somalia, as the country would have to abide by the decision.
However, the government, through lawyer Paul Nyamodi, maintained that the petition is based on an assumption that the ICJ will rule in favour of Somalia and that Kenya has taken steps to ensure its territorial integrity and independence are not compromised.
Mr. Mungai countered that sustaining the case at the ICJ offends the Constitution and could lead to the alteration of Kenya's territory without a referendum.
The judges will rule on the matter on November 7.
