On October 19, 2019, the High Court in Mombasa issued an order stopping Rentworks East Africa Ltd from confiscating equipment worth millions of shillings from Nakumatt Supermarkets over more than Sh42 million debt.
Nakumatt had leased equipment from Rentworks EA Ltd on December 20, 2004, for an indeterminate period at an agreed monthly rental payment, which was later extended in January 14, 2008.
According to Nakumatt's lawyer, D Ngonze, the supermarket had already paid Rentworks Sh2.4 million, as per a contract dated January 25, 2019, which included payment of Sh1,807,447, including VAT, until payment in full.
However, following Nakumatt's financial turmoil, they were unable to pay the monthly dues, leading to the current dispute.
Justice Jaden Thuranira granted an unconditional stay of execution of the attachment commenced on September 23, 2019, for 30 days pending an inter-parties hearing.
