Kenya's Participation in Somalia Maritime Case: High Court Ruling Looms

On November 7, 2019, a three-judge bench of the Kenyan High Court will deliver its ruling on a petition involving the maritime boundary case between Kenya and Somalia.

The petition, filed by 20 individuals, seeks to stop Kenya from participating in the case pending before the International Court of Justice (ICJ), citing concerns that the dispute may alter the countries' boundaries illegally.

However, the Attorney General has objected to the petition, arguing that issues related to border lines fall under foreign policy and are beyond the court's jurisdiction.

Lawyer Paul Nyamodi, representing the Attorney General, stated, 'Multiple considerations and factors need to be borne in mind in determining the nature of foreign relations and policy.'

The hearing of the maritime dispute is scheduled to take place at the ICJ in The Hague, Netherlands, from September 9 to 13, with each country given two days to defend their cases.

According to the court's program, Somalia will present its case on September 9, followed by Kenya's response on September 11.
