On October 15, 2019, the Independent Electoral and Boundaries Commission (IEBC) issued a summons to ODM Party Chairman John Mbadi in response to a complaint filed by Jubilee Party's candidate in the Kibra by-election, McDonald Mariga.
Mariga had alleged that ODM supporters, acting on the party's leadership, orchestrated the violent scenes witnessed at one of his rallies on October 12.
According to the IEBC, Mbadi is required to file the party's response to the accusations within 24 hours and appear at the IEBC headquarters on October 18.
IEBC stated that 'should you fail to file a response and enter an appearance within the time mentioned above, the complaint will be heard and determined in your absence.'
During the incident, Mariga was forced to flee after his campaign convoy was pelted with stones.
