Court Allows Woman to Exhume Husband's Remains After 14 Years

Published on October 15, 2019, a High Court judge in Kenya made a historic decision allowing Lucy Muthoni to exhume the remains of her husband, Samuel Kahihia, who had been buried for 14 years at a public cemetery in Nakuru County.

The court's decision was made after Muthoni's application, dated September 27, 2019, was supported by her brother-in-law, Joseph Macharia, and three of his sisters, who confirmed that the family dispute had been resolved.

According to court documents, Samuel Kahihia died on September 22, 2005, and was buried at the Nakuru North Cemetery due to a family dispute. However, the extended family had since resolved the issue and agreed to give Kahihia a decent burial at their ancestral home in Othaya, Nyeri County.

High Court judge Teresia Matheka directed the Nakuru County Public Health Officer to ensure the exhumation order was carried out, allowing Muthoni to rebury her husband's remains at their ancestral home.
