On October 11, 2019, Justice Stella Mutuku made the ruling at the Milimani courts, stating that the prosecution had not met the required standards to keep Sarah Wairimu in remand.

As part of her bail conditions, Wairimu will be required to deposit two sureties of Sh2 million each if she cannot pay the cash bail. She has also been barred from visiting her matrimonial home and must seek the court's permission for any requirements.

Wairimu has been charged with the murder of her husband Tob Cohen on the night of July 19 and 20 in Nairobi, a charge she has denied. The Directorate of Criminal Investigation has been directed to continue holding her passport pending further directions from the court.

Meanwhile, businessman Peter Karanja, also implicated in the murder, has denied the murder charge and is being detained pending the hearing of his bail application on Thursday.

Justice Mutuku directed the two cases to be mentioned on November 12 when they will be consolidated, following a request from the DPP to have them consolidated.
