Published on October 11, 2019, a court in Kenya has given Kibos Sugar factory permission to file a key environmental report by the National Environment Management Authority (Nema) in an ongoing case.
The report, which was not considered in the initial judgment, is expected to provide crucial evidence in the appeal case. The factory was previously ordered to halt operations due to claims of polluting the environment.
Justice Asike Makhandia directed the factory to file the report as an affidavit, stating that the documents from the environmental watchdog were authentic.
Defense lawyers had previously questioned the credibility of the documents, but the judge's ruling has given the factory a chance to present its side of the story.
The appeal case will be heard on October 29.
