Court Stops Sale of KPA Property

On October 11, 2019, the High Court in Mombasa issued a temporary injunction stopping the sale of houses belonging to the Kenya Ports Authority Pension Scheme. The court's decision was made by Lady Justice Dorah Chepkwony, who ruled that the sale of prime properties, including houses, should be halted pending the determination of a suit.

According to the court's order, the sale of the properties, including houses, movable and immovable assets of KPA, was to be stopped until the matter was referred to arbitration and heard and determined. The order was issued in response to a suit filed by Bwana Mohamed Bwana, a pensioner, who sought to stop KPA from selling his house in Nyali.

More than 2,000 KPA staff members under the scheme also filed a similar application seeking to stop the KPA-registered trustees from selling their houses. The pensioners from Mombasa and Nairobi argued that the pension scheme took over the management of various houses following non-remittance of monies to the scheme by the authority.

The signatories of the pension scheme stated that the scheme assumed the ownership of the property with the staff in occupation becoming its tenants. They claimed that the registered trustees had advertised for the sale of all KPA pension scheme houses.
