Court Chaos: State Counsel Summons Dead Witness

On October 10, 2019, a bizarre incident unfolded at the Limuru Law courts, leaving many in shock. A State Counsel, assigned to the court, made a grave mistake by summoning a dead witness to testify in a robbery with violence case.

The deceased, a taxi driver, had been declared dead on arrival at Tigoni Hospital after succumbing to inflicted injuries. The case involved the fatal shooting of Alphaxad Kinyanjui, a brother of George Boro, who was present in court.

Confusion reigned as the State Counsel mentioned the victim's name as one of the witnesses present in court to testify. However, calmness returned after George Boro intervened, informing the State Counsel that the person summoned had died on the same night he was shot.

The accused, David Njenga, Samuel Gicheha, and Solomon Wachira, denied the murder allegations and all other charges, including robbery with violence. The case was scheduled for hearing on February 4, 2020, by Senior Principal Magistrate Hon. Evelyn Olwade.

Despite the mishap, the family absolved the State Counsel, citing that he was not acquainted with the case and had not perused the file.
