Uhuru and Raila's BBI Victory: Court Throws Out Activist's Petition

On October 9, 2019, President Uhuru Kenyatta and Orange Democratic Movement (ODM) leader Raila Odinga celebrated a court victory after a petition filed by activist Moraa Gesicho challenging the Build the Bridges Initiative (BBI) was thrown out.

According to reports, activist Moraa Gesicho had filed a case in court on September 18, 2019, demanding the suspension of the BBI project, claiming the taskforce behind BBI was illegally constituted.

Activist Moraa further alleged that President Kenyatta had no powers to consult the opposition leader Raila on how to govern the country, demanding an immediate suspension of the BBI project.

However, Constitutional and Human Rights Division Justice Weldon Korir ruled in favor of the BBI team, explaining that Moraa was not able to prove that she could suffer prejudice if the report reached the president.

Lawyers from the BBI team had responded to Moraa's petition by asking the court to dismiss it, claiming Moraa's move was a court abuse and she was petitioning BBI to gain political mileage.
