EDITORIAL: NLC Clause is Proper

On October 8, 2019, the National Land Commission (NLC) clause was at the center of a heated debate.

President Uhuru Kenyatta's administration had introduced the clause, which allows anyone with a first degree and 10 years of experience to serve as a commissioner on the NLC.

The Institute of Surveyors of Kenya (ISK) chairman opposed the clause, arguing that only those qualified in land matters should serve on the commission.

However, the ISK's stance was met with criticism from those who believed that land matters involve more than just technical issues.

According to the NLC Act, a commissioner must hold a first degree in any field and have at least 10 years' experience in public administration, natural resources management, and/or social sciences.

The ISK saw this as a loophole, but the provision is properly worded and should remain as such.
