On October 3, 2019, the High Court made a significant ruling in the Tob Cohen murder case, allowing Philip Murgor to continue representing Sarah Wairimu.
Justice Stella Mutuku justified Murgor's representation, stating that his resignation as a state prosecutor was sufficient to break any ties with the DPP's Office.
The court's decision came after Cohen's family lawyer, Cliff Ombeta, accused Murgor of breaking the law by representing a murder suspect while still under the state prosecutor's umbrella.
Wairimu is accused of murdering her husband, Tob Cohen, and dumping his body in a manhole at their home in Kitisuru.
The court's ruling has allowed Wairimu's plea taking to proceed, which was previously postponed for the fourth time to allow the court to establish whether there was any conflicting interests.
