Philip Murgor Cleared to Represent Sarah Wairimu in Tob Cohen Murder Case

On October 3, 2019, the High Court made a ruling that allowed advocate Philip Murgor to represent Sarah Wairimu Kamotho in the Tob Cohen murder case.

Philip Murgor's appointment as public prosecutor, gazetted on January 16, 2019, had raised concerns about a potential conflict of interest. However, Justice Stella Mutuku ruled that Murgor's resignation in March 2019 was sufficient, as no one can be forced to remain in office against their will.

Senior assistant DPP Catherine Mwaniki had argued that the process of degazetting Murgor's appointment was underway and that due process must be followed. However, the court ultimately sided with Murgor, clearing the way for him to represent Sarah Wairimu.
