Kiambu Deputy Governor James Nyoro is seeking to lift a court order that bars him from reshuffling the county's executive members, citing the need to ensure smooth service delivery.
Mr. Nyoro, through his lawyer Kibe Mungai, argued that the court order issued by Justice Onesmus Makau last week was unjustified and has hindered the delivery of services in the county.
Justice Makau had barred Mr. Nyoro from reshuffling any members of the county executive or any other chief officers, citing a petition filed by a resident, Ms. Marione Njeri Njoroge, who claimed that Mr. Nyoro had made numerous irregular appointments and reshuffled the county executive members without any legal basis.
Mr. Nyoro, however, argued that he has been discharging his duties diligently since taking over the running of the county after Governor Ferdinand Waititu was barred from accessing his office over corruption charges.
He also questioned the jurisdiction of the court to issue the order and the fact that there are two pending matters before the High Court over the same issue.
"In view of the foregoing, the proceedings herein should be stayed and the conservatory orders granted pending inter partes hearing," Mr. Mungai submitted.
