Kenya: Court Stops Motor Vehicle Leasing Tender

On October 3, 2019, a Kenyan court intervened in a contentious motor vehicle leasing tender, halting the process after a petition by CMC Motors Group Ltd.

The company, represented by lawyer Migos Ogamba, argued that Interior PS Karanja Kibicho had advertised the tender through restricted tendering, before the expiry of the 14 days required by law.

According to Ogamba, the Public Procurement Administrative Review Board had failed to consider essential factors, including the introduction of new vehicle models and the absence of a proper actuarial price matrix.

Justice John Mativo consequently suspended the decision and orders issued by the board, directing Ogamba to serve the PS and the board and come back for directions on October 8.
