On October 1, 2019, activist Okiya Omtatah wrote to the Ethics and Anti-Corruption Commission (EACC) requesting an investigation into the citizenship status of several lawmakers.
According to Omtatah, at least 10 lawmakers, including two senators and eight members of the National Assembly, hold dual citizenship. The lawmakers in question include Yusuf Hassan Abdi, MP Kamukunji (UK), Safia Sheikh Adan, Marsabit (Somali & Ethiopia), Man Haji Ali, MP Mandera South (Somali), Mohammed Dahir Duale, MP Dadaab (Somali), Mohammed Garane, MP Lagdera (Somali), Charles Ngusya Nguna, MP Mwingi West (Greece), and Jane Kihara, MP Naivasha (US).
Senators mentioned to be holding dual citizenship include Narok Senator Olekina Ledama (US) and his Nakuru counterpart Susan Kihika (US). Omtatah has, however, reiterated that the source of the claims was “credible but confidential” information.
Ms Mwinzi, who is a US-born Kenyan, has protested the move and petitioned the High Court to find that the verdict by the Defence and Foreign Relations Committee chaired by Katoo ole Metito was a violation of her rights.
“In the spirit of adhering to the rule of law and applying the law consistently and equally to all, it’s of overwhelming national importance and public interest that our legislators submit themselves to the same standards they have set for diplomats,” Omtatah’s letter reads.
EACC Communications officer Yasin Amaro said the agency would investigate the veracity of the claim.
