On October 1, 2019, a Kajiado teacher and two men from Mombasa County were arrested and arraigned at the Kajiado Law Courts for allegedly engaging in homosexuality.
The three individuals, George Sane, a teacher at Marhab Girls Secondary School, Dickens Ouma, and Martin Kithure, were charged with engaging in an unnatural act contrary to Section 162(a) of the Penal Code.
According to the court, George Sane had sexual intercourse with Ouma and Kithure against their order of nature. The three had met on Facebook and agreed that Sane would pay each of the two men Ksh.10,000 for the sexual act.
However, Sane failed to pay the agreed amount and insisted on paying half the price, prompting Ouma and Kithure to report the matter at Kajiado Police Station.
The three were arrested and arraigned for practicing homosexuality, but denied the charges and were released on a cash bail of Ksh.100,000 each.
Section 162(a) of the Penal Code stipulates that any person who has carnal knowledge of another person against the order of nature is guilty of a felony and liable to imprisonment for fourteen years.
