On October 1, 2019, the prosecution in the Tob Cohen murder case faced allegations of defying a court order, sparking a contempt of court case.
Philip Murgor, Sarah Wairimu Cohen's lawyer, accused the prosecution of leaking information to the media, specifically a report that a second cousin of President Uhuru Kenyatta had been arrested in connection with the case.
According to Murgor, he had called the journalists who published the story and they claimed to have been given the information by the Director of Criminal Investigations (DCI).
Murgor stated, 'There's a publication that a second cousin of President Uhuru Kenyatta has been arrested. I called the journalists and he said he was given the information by the DCI.'
The lawyer threatened to sue the DCI for leaking the information, which he claimed was a breach of the court's directive to the prosecution and investigating teams not to comment on the case outside of court.
The prosecution, led by Catherine Mwaniki, rejected the claims, stating that they would investigate the source of the leak.
Justice Stella Mutuku warned that contempt of court matters attract sanctions and the court would scrutinize the authorities on the seriousness of the contempt allegations.
It is worth noting that last week, the prosecution had accused Wairimu of contempt of court for speaking publicly about the case during her husband's burial, where she warned the killers that their days were numbered.
Additionally, Nancy Kigwa Wettstein, a well-known queen of hair and beauty, was questioned by the DCI officers over Tob Cohen's murder on Monday.
She is a close friend of Sarah Wairimu and the proprietor of Rembo Hair Salon and Pivot Point.
