On September 30, 2019, a Mombasa court heard two separate cases against tax agents accused of aiding companies to evade Sh2,146,580 in value-added tax (VAT).
According to the charges, the tax agents from Ogot and Associates, together with directors of Gaab Transporters Limited and Samumu Construction Services, were accused of making incorrect statements to the Commissioner for Domestic Taxes in their companies' VAT returns.
One of the cases involved Mohamed Moalin Mohamed, a director of Gaab Transporters Limited, and his tax agents, Wilson Ogot Owera, David Osore Wesonga, and Rolland Anakaya Chiriswa. They were jointly charged for knowingly making an incorrect statement to the Commissioner for Domestic Taxes in the company's VAT returns for the months of March, April, May, and June 2016.
The incorrect statement reduced the company's VAT liability for the months by Sh1,593,908.
In the second case, Sammy Kamuio, a director of Samumu Construction Services Limited, and his tax agents, Wilson Ogot Owera, David Osore Wesonga, and Rolland Anakaya Chiriswa, were charged with making an incorrect statement to the Commissioner for Domestic Taxes in the company's VAT returns for the month of April 2016.
The incorrect statement reduced the company's VAT liability for the month by Sh552,672.
Both cases will be heard on October 17, 2019.
The accused pleaded not guilty and were released on a bond of Sh200,000 with an alternative cash bail of Sh100,000.
