Ms Sarah Wairimu Kamotho, accused of murdering her husband Tob Cohen, will plead to the charge next week after a dispute over her representation by Philip Murgor.
The plea was initially set for September 26 but was pushed to October 1 after the prosecution and lawyer Cliff Ombeta for the Cohen family contested Ms Wairimu's representation by Philip Murgor.
State prosecutor Catherine Mwaniki requested the postponement, stating that she needed to verify whether Philip Murgor was still a state prosecutor, as he had been appointed by the Director of Public Prosecutions Noordin Haji in January 2019.
Philip Murgor, however, denied the allegations, stating that he had resigned as a state prosecutor on March 7, 2019, after waiting for two months without being assigned any cases.
The court directed the Director of Public Prosecutions Noordin Haji to clarify whether Philip Murgor's appointment had been revoked or not.
Ms Mwaniki also requested time to file contempt proceedings against Philip Murgor and his client for commenting on the case during the burial of the late Cohen, in breach of a court order.
Ms Mwaniki further requested that some of the prosecution witnesses be placed under protection, citing concerns for their safety.
