On September 26, 2019, Sarah Wairimu's plea was delayed due to a dispute over her lawyer representation. The issue arose after claims that her lawyer, Philip Murgor, was appointed as a public prosecutor on January 19, 2019, for a period of two years.

Lawyer Cliff Ombeta questioned the appointment, stating that there was no Gazette notice revoking the fact. He argued that if the Director of Public Prosecution, Noordin Haji, had not revoked the appointment, Murgor should go to the Judicial Review Division.

However, Murgor denied the allegations, stating that he had wasted two months with no work assigned to him and subsequently resigned on March 7, 2019. He claimed that the revocation of a Gazette notice was of no consequence and that Ombeta should have filed a formal application challenging his position.

High Court Judge Stella Mutuku ruled that Sarah Wairimu should be remanded until October 1, 2019, until the issue of representation was dealt with.
