Woman Seeks Court Permission to Exhume Husband's Body Buried 14 Years Ago

On September 22, 2005, Samuel Kimangu passed away due to immunosuppression syndrome caused by Anaemia. His wife, Lucy Muthoni, is now seeking a permit from the Nakuru High Court to exhume his body, which was buried a week later at Nakuru Cemetery.

The dispute over where Kimangu should be buried led to a temporary burial at Nakuru Cemetery. However, after 14 years, the family resolved their dispute and agreed to bury him at his ancestral home in Othaya, Nyeri County.

Muthoni, who is the only surviving wife of the late Kimangu, has filed an application seeking permission to exhume the body and rebury it at the ancestral land, which belongs to Benjamin Macharia, Kimangu's father.

According to Muthoni, the family has resolved their disputes and wishes to give Kimangu a decent burial at his father's home in Othaya. She believes that no one, including the state, Nakuru County, and Nyeri County, will suffer any prejudice if the body is exhumed and reburied.

Justice Rachel Ng'etich has directed Muthoni to serve the application to the ex-parte and set October 2 as the date the court will give its direction in the matter.
