On September 25, 2019, a Kiambu resident, Marion Njoroge, filed a petition against Kiambu Deputy Governor James Nyoro, claiming he was acting in violation of his powers.
The petitioner argued that Nyoro had purported to reshuffle, dismiss, and assign executive secretaries, thereby acting in excess of his powers.
According to the petitioner, Nyoro violated Article 179 (5) of the Kenyan Constitution by exercising powers limited to the Governor.
Earlier this month, another Kiambu resident moved to court to challenge Nyoro for reshuffling the County Executive Committee members (CECs).
Magistrate Lawrence Mugambi had earlier ruled that Governor Ferdinand Waititu be blocked from accessing his office at the Kiambu County until the case is heard and determined.
Just hours after the ruling, Waititu's deputy Nyoro announced that he would be taking charge and pushing for the impeachment of his boss.
However, one Bernard Chege Mburu moved to court arguing that the Deputy Governor was purporting to exercise powers that he did not have in law.
