On September 20, 2019, Sarah Wairimu, the estranged wife of the late Tob Cohen, filed an urgent application with the High Court seeking temporary leave from custody to attend his burial on Monday, September 30, 2019.
According to the application, Wairimu's lawyers sought permission to temporarily release her from custody to allow her to attend the funeral, which is set to take place at the Jewish Cemetery on Wangari Mathai Road at 2 pm on Monday.
High Court Judge, Lady Justice Jessie Lessit, had earlier ordered Wairimu's detention for a mental assessment before she could be charged with Cohen's murder on Thursday, September 26.
Wairimu's application for release was certified urgent, and parties were ordered to attend a court session slated for Monday at 8:30 am for directions.
The burial is pegged on four conditions agreed upon by Wairimu and Cohen's sister, Gabrie Van Straten, through their legal representatives.
These conditions include barring friends from attending the burial, which Wairimu's lawyer, Phillip Murgor, said had been agreed upon by both parties.
Lawyer Cliff Ombeta stated that Cohen's sister had agreed to Wairimu's participation in the funeral.
