On Thursday, Senior Principal Magistrate Kennedy Cheruiyot directed the release of Humphrey Kariuki's two passports, allowing him to travel abroad for urgent business engagements.
The court's decision came after Kariuki voluntarily appeared in court, having been summoned earlier.
Cheruiyot stated, 'I direct that his two passports be released to allow him travel abroad as may be necessary but let the accused provide a surety to guarantee his return to court.'
Kariuki's lawyer, Cecil Miller, had requested the court to allow his client to travel to the US, Europe, and Gabon for business engagements beginning Monday next week.
He is also expected to travel again between October and December this year.
Miller submitted that Kariuki showed good conduct by surrendering himself to the DCI after being summoned and eventually charged.
Kariuki was granted bail by Chief Magistrate Francis Andayi after denying tax evasion charges amounting to Sh41 billion.
The case will be mentioned on September 26.
