On September 19, 2019, the High Court reduced the jail term of former Kenya Reinsurance Corporation finance director John Faustin Kinyua from three years to one year and four months.
The reduction in sentence came after Mr. Kinyua appealed against the initial sentence, claiming that there was no proof that Kenya Re lost the house in question.
However, Justice Mumbi Ngugi found that there was no evidence that the house, which was transferred to former Heritage Insurance manager Charles Kinutha Gichane, had been recovered.
As a result, the court ordered the house to be returned to Kenya Re and reduced the fine from Sh6.3 million to Sh393,792, with Mr. Kinyua facing four months in jail in default.
Mr. Kinyua was initially found guilty of abuse of office and ordered to pay a fine of Sh1 million, with a default sentence of one year's imprisonment.
He was also ordered to pay a mandatory fine of Sh6.3 million, which the High Court later substituted with Sh393,792.
Mr. Kinyua's case dates back to May 2019, when he was found guilty of tricking taxpayers into buying a house in Embakasi's Villa Franca Estate.
