Tob Cohen's Body: Lawyer Insists Only Sarah Wairimu Can Claim It

On September 18, 2019, the postmortem of the late Tob Cohen was conducted at the Chiromo mortuary. Following the exercise, Philip Murgor, the lawyer representing Sarah Wairimu Cohen, revealed that his client has demanded that the body of the late Cohen not be released to anyone else.

Speaking outside the mortuary, Murgor emphasized that Sarah is innocent under the Kenyan Constitution and has not been proven guilty. He criticized Cohen's sister for indicating that she would be burying the body under Jewish custom, stating that this is not a valid reason for denying Sarah her rights.

According to Murgor, Sarah is still lawfully married to the late Cohen and is entitled to his body. He maintained that she is innocent until proven guilty and that the charge against her does not take away her right to her husband's body.

“The notion that the sister is entitled to the body is alien in the Kenyan Law….. Sarah is innocent under the Kenyan Constitution and nothing has happened so far to take away her right to her husband’s body,” Murgor said.

He added, “What we have is a charge which shall be dealt with in court but the act of being charged does not take way the right of a wife to a husband’s body and the right to bury it with the dignity deserved.”
