On September 2-3, 2019, a 17-year-old girl was allegedly defiled at a guest house in Kisii town.
Mr. Fred Nyachae Omaiyo, the MCA for Magwagwa ward in Nyamira County, was charged with the crime on Monday.
The prosecution alleges that Omaiyo committed the act contrary to Section 11(1) of the Sexual Offences Act No. 3 of 2006.
Appearing before Nyamira Law Courts, Omaiyo denied the charges through his lawyer, Omoke Morara.
However, the prosecution, led by State counsel Desmond Majale, opposed the accused's request for bail, citing concerns that he might interfere with witnesses.
The court ruled that Omaiyo be detained for seven days pending a bail ruling, which will be made on Monday next week.
