Mombasa Magistrate Kagoni Arrested Over Missing Ksh.30M Heroin

On Friday, detectives from the Directorate of Criminal Investigations (DCI) arrested Mombasa Law Courts Principal Magistrate Edgar Kagoni in connection with the loss of approximately 10kgs of heroin valued at Ksh.30 million and Ksh.600,000 cash in July last year.

According to a statement from the Director of Public Prosecutions (DPP), Magistrate Kagoni will be charged alongside three others with obstruction with intent to defeat justice and aiding and abetting trafficking in narcotic drugs.

Magistrate Kagoni delivered his judgment on June 11, 2019, convicting Hussein Massoud Eid for trafficking in narcotic drugs and sentencing him to 30 years in prison, with an additional fine of Ksh.90 million.

However, Magistrate Kagoni made an order to return Ksh.600,000 cash to the convicted person, breaching sections 36 and 78 of the Narcotic and Psychotropic Substances (control) Act No.4 of 1994, which required forfeiture of the seized property upon conviction.

The three others charged alongside Magistrate Kagoni are Abdalla Awadh Abubakar, Lawrence Thoya Bayan, and Onesmus Momanyi.
